Welcome to Kalgi Jewellery. These Terms of Service ("Terms") govern your access to and use of the website kalgijewellery.com (the "Site") and any purchase you make from us. The Site is owned and operated by Kalgi Jewellery, a sole proprietorship registered in India ("we", "us", "our"). By accessing the Site, browsing, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

By using the Site or placing an order, you confirm that you are at least 18 years of age, or are accessing the Site under the supervision of a parent or legal guardian, and that you are legally capable of entering into a binding contract under the Indian Contract Act, 1872.

2. Products and Descriptions

We sell jewellery and related items. We make every effort to display the colour, design, weight, and details of our products as accurately as possible. However, because jewellery is often handcrafted and because screen displays vary, the actual product may differ slightly from the images shown on the Site. Minor variations in weight, finish, stone colour, and dimensions are inherent to jewellery and are not considered defects. Product weights and specifications are indicative unless expressly stated as certified.

3. Pricing and Payment

All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices, offers, and product availability are subject to change without notice. We reserve the right to correct any errors in pricing or product information and to cancel any orders placed on the basis of such errors, even after an order has been confirmed.

We accept payment through the methods displayed at checkout, including online payment options and Cash on Delivery (COD), where available. COD may not be available for all products, order values, or delivery locations, and we reserve the right to limit or withdraw the COD option at our discretion. For COD orders, the exact amount must be paid to the delivery partner at the time of delivery.

4. Order Acceptance

Your order is an offer to purchase. All orders are subject to acceptance and availability. We may, at our discretion, refuse or cancel any order for reasons including but not limited to product unavailability, errors in pricing or product information, or suspected fraudulent or unauthorised activity. If we cancel an order for which you have already paid, we will refund the amount paid using the original payment method.

5. Shipping and Delivery

We currently ship within India only. Delivery timelines shown on the Site are estimates and are not guaranteed. Delivery may be affected by factors outside our control, including courier delays, weather, and regional restrictions. Risk of loss and title for items pass to you upon delivery to the shipping address provided at checkout. Please ensure that the shipping address and contact details you provide are accurate and complete; we are not responsible for orders delayed or lost due to incorrect information provided by you.

6. Returns, Exchanges, and Refunds

We want you to be satisfied with your purchase. You may request a return within 7 (seven) days of delivery, subject to the following conditions:

• The item must be unused, unworn, and undamaged, in its original condition with all original packaging, tags, invoices, and certificates (if any) intact.
• You must provide proof of purchase.
• Made-to-order, customised, engraved, or personalised items are not eligible for return or exchange, except where the item is damaged or defective on arrival.
• Items marked "final sale" or purchased during clearance are not eligible for return unless damaged or defective.

To initiate a return, contact us at info@kalgijewellery.com with your order number and details. Once we receive and inspect the returned item, we will notify you of approval or rejection. Approved refunds will be processed to the original payment method within 15 business days. For COD orders, refunds will be issued to a bank account or UPI ID that you provide. Shipping charges are non-refundable unless the return is due to our error or a defective item. Return shipping costs may be borne by you unless the item is damaged, defective, or incorrect.

If you receive a damaged, defective, or incorrect item, please contact us within 48 hours of delivery with photographs so we can arrange a replacement, exchange, or refund.

7. Cancellations

You may request cancellation of an order before it has been dispatched by contacting us at info@kalgijewellery.com. Once an order has been dispatched, it cannot be cancelled but may be handled under our returns policy above. We reserve the right to cancel orders as described in Section 4.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, product designs, and the "Kalgi Jewellery" name and branding, is our property or that of our licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or use any content from the Site for commercial purposes without our prior written consent.

9. User Conduct

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to submit false or misleading information, or to infringe the rights of others. We reserve the right to suspend or terminate access to any user who violates these Terms.

10. Third-Party Links and Services

The Site may contain links to third-party websites and rely on third-party services (such as payment gateways and courier partners). We are not responsible for the content, policies, or practices of third parties. Your use of such services is governed by their respective terms and policies.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or any products purchased. Our total liability for any claim relating to a product shall not exceed the amount you paid for that product. Nothing in these Terms limits any rights you have under applicable consumer protection laws, including the Consumer Protection Act, 2019.

You agree to indemnify and hold harmless Kalgi Jewellery and its proprietor from any claims, losses, liabilities, or expenses arising out of your breach of these Terms or your misuse of the Site.
